1. Definitions

For the purposes of these Terms and Conditions:

  • "Platform" means the website and services operated by SEA VENTOR LTD.
  • "Customer" means any individual or legal entity using the Platform to book maritime services.
  • "Provider" means an independent boat owner, charter company, captain, or maritime service provider offering services through the Platform.
  • "Booking" means any reservation made through the Platform.
  • "Services" means boat rentals, charters, excursions, transfers, cruises, or related services provided by Providers.
  • "User" means any Customer or Provider using the Platform.

2. Acceptance of Terms

By accessing, browsing or using the Platform, Users acknowledge that they have read, understood and agreed to be legally bound by these Terms and Conditions. If a User does not agree with these Terms, the User must immediately cease using the Platform.

SEA VENTOR LTD reserves the right to amend these Terms at any time. Continued use of the Platform constitutes acceptance of any amendments.

3. Nature of the Platform

SEA VENTOR LTD operates exclusively as an online marketplace and booking intermediary. The Platform enables Customers to locate and book services offered by independent Providers.

SEA VENTOR LTD does not own, manage, operate, maintain, crew, navigate, inspect or insure any vessel listed on the Platform unless expressly stated otherwise. All services displayed on the Platform are supplied directly by independent Providers.

4. Intermediary Status

SEA VENTOR LTD acts solely as an intermediary between Customers and Providers. SEA VENTOR LTD is not a travel agency, tour operator, shipping company, vessel owner or carrier. The contract for the provision of maritime services is concluded directly between the Customer and the relevant Provider.

Providers operate independently and are solely responsible for:

  • Vessel operation and navigation.
  • Safety procedures.
  • Compliance with applicable laws.
  • Insurance coverage.
  • Licenses and certifications.
  • Crew qualifications.
  • Vessel maintenance.
  • Passenger safety.

SEA VENTOR LTD assumes no responsibility for acts, omissions, negligence or misconduct of Providers.

5. Eligibility

Users must be at least eighteen (18) years old and legally capable of entering into binding agreements. By using the Platform, Users represent and warrant that they possess the legal capacity to enter into such agreements. SEA VENTOR LTD reserves the right to refuse service or terminate accounts at its sole discretion.

6. User Accounts

Users may be required to create an account. Users are responsible for maintaining the confidentiality of their login credentials and agree to provide accurate and up-to-date information. SEA VENTOR LTD reserves the right to suspend or terminate accounts containing false or misleading information.

7. Booking Process

Bookings made through the Platform constitute requests for services provided by independent Providers. Confirmation of a booking is subject to acceptance by the relevant Provider. Prices displayed on the Platform are established by Providers. SEA VENTOR LTD reserves the right to correct obvious pricing or technical errors.

Upon confirmation, a direct contractual relationship is formed between the Customer and the Provider. SEA VENTOR LTD acts solely as an intermediary facilitating the booking process.

8. Payments

Payments may be processed through third-party payment providers including Stripe. SEA VENTOR LTD does not store complete payment card details. Users acknowledge that payment processors operate under their own terms and privacy policies. SEA VENTOR LTD shall not be liable for failures, delays or interruptions affecting third-party payment systems.

9. Provider Responsibilities

Providers are solely responsible for compliance with maritime legislation, vessel seaworthiness, safety equipment, insurance, crew qualifications, navigation, environmental compliance and passenger safety.

Providers bear exclusive responsibility for accidents, injuries, losses, delays, damages and claims arising from their services.

10. Customer Responsibilities

Customers agree:

  • To comply with applicable laws.
  • To follow safety instructions.
  • Not to engage in illegal activities.
  • Not to damage vessels or equipment.
  • Not to endanger passengers or crew.
  • To provide truthful information.

Customers remain liable for damage caused by their conduct.

11. Cancellation Policy

SEA VENTOR LTD applies a strict cancellation framework. Each Provider determines and administers its own cancellation, modification and refund policies. By completing a Booking, Customers acknowledge and accept the cancellation terms established by the relevant Provider.

SEA VENTOR LTD acts solely as an intermediary and shall not be responsible for refund decisions made by Providers. Any disputes concerning cancellations or refunds shall be resolved directly between the Customer and the Provider.

12. Weather Conditions and Force Majeure

SEA VENTOR LTD shall not be liable for delays, modifications or cancellations caused by adverse weather conditions, sea conditions, mechanical failures, port authority decisions, government restrictions, natural disasters, epidemics or pandemics, acts of war, strikes, terrorist acts, civil unrest or events beyond reasonable control.

In such circumstances, the Provider shall determine whether services can proceed safely.

13. Assumption of Risk

Customers acknowledge that maritime activities involve inherent risks including rough sea conditions, slips and falls, collisions, mechanical failures, injury or illness, delays and adverse weather conditions.

Customers voluntarily assume all risks associated with participation in maritime activities. Participation is undertaken entirely at the Customer's own risk.

14. Disclaimer of Warranties

The Platform and Services are provided on an "as available" and "as is" basis. SEA VENTOR LTD makes no guarantees regarding availability, reliability, accuracy, suitability, quality, safety or performance of Providers.

SEA VENTOR LTD expressly disclaims all warranties, whether express or implied, to the fullest extent permitted by applicable law.

15. Limitation of Liability

To the fullest extent permitted by law, SEA VENTOR LTD, its directors, officers, shareholders, employees, affiliates and agents shall not be liable for personal injury, death, property damage, loss of income, loss of enjoyment, travel expenses, indirect damages, consequential damages, special damages, punitive damages, delays, mechanical failures, or acts or omissions of Providers.

Under no circumstances shall the total liability of SEA VENTOR LTD exceed the amount of commission actually received by SEA VENTOR LTD in connection with the specific Booking giving rise to the claim.

16. Insurance

Insurance coverage relating to vessels, passengers and operations is the sole responsibility of the Provider. SEA VENTOR LTD does not provide insurance coverage for vessels, Customers or Providers. Users are encouraged to obtain personal travel and medical insurance.

17. Intellectual Property

All content contained on the Platform, including logos, trademarks, text, graphics, images, software, databases and designs, is the exclusive property of SEA VENTOR LTD and is protected by applicable intellectual property laws.

No material may be reproduced, distributed or used without prior written consent from SEA VENTOR LTD.

18. Indemnification

Users agree to indemnify, defend and hold harmless SEA VENTOR LTD, its directors, officers, employees and affiliates from and against any claims, losses, damages, liabilities, costs and expenses, including legal fees, arising from use of the Platform, breach of these Terms, violation of applicable laws, claims relating to Bookings, or negligence or misconduct by Users.

19. Suspension and Termination

SEA VENTOR LTD reserves the right to suspend or terminate any account or restrict access to the Platform without prior notice where false information has been provided, fraudulent activity is suspected, illegal conduct is identified, or these Terms have been violated.

Termination shall not affect rights and obligations accrued before termination.

20. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Cyprus. Any dispute arising out of or in connection with these Terms or use of the Platform shall be subject to the exclusive jurisdiction of the Courts of the Republic of Cyprus.

21. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

22. Entire Agreement

These Terms constitute the entire agreement between Users and SEA VENTOR LTD concerning use of the Platform and supersede any prior agreements or understandings.
